2. Use of the Platform and Services

  • Access: PicaPic provides an online platform where users can access, view, and download event photographs using valid event links, access codes, or secure tokens provided by photographers or event organizers.

  • Eligibility: You must be at least 18 years of age, or have valid parental/guardian consent, to use this service.

  • Acceptable Use: You agree not to misuse the platform, attempt unauthorized access to restricted galleries, introduce malware, or use automated scrapers to harvest content from the site.

3. Intellectual Property and Copyright

  • Ownership: All photographs displayed on PicaPic remain the intellectual property of the respective professional photographer or event creator, protected under the Copyright, Designs and Patents Act 1988.

  • Personal Use License: Downloading a photograph grants you a non-exclusive, non-transferable license for personal, non-commercial use only (such as printing for personal display, sharing with family, or posting on personal social media accounts).

  • Commercial Restrictions: You may not sell, license, alter, or use the images for any commercial purposes (including business marketing, advertising, or resale) without explicit written permission from the copyright owner.

4. Image Availability and Storage

  • Temporary Hosting: Event galleries are hosted temporarily. PicaPic does not guarantee permanent archival storage. Galleries typically remain active for a limited time (e.g., 3 to 6 months) following the event date.

  • User Responsibility: Users are strongly advised to download and securely back up their digital copies as soon as possible. PicaPic is not liable for the permanent loss or removal of event galleries after the hosting period expires.

5. Limitation of Liability (UK Consumer Law)

  • As-Is Basis: The platform and images are provided on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied.

  • Business Users: If you are using our services for business or commercial purposes, PicaPic excludes all implied conditions, warranties, representations, or other terms that may apply. We will not be liable for any loss of profit, business, business interruption, or loss of business opportunity.

  • Consumers: If you are a consumer using our platform, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. We do not exclude or limit in any way our liability to you where it would be unlawful to do so (including liability for death or personal injury caused by our negligence or fraud).
